General Terms of Sales

The terms and conditions set out below govern the sale of goods from the on-line shop at www.citronille.fr

By placing an order for goods from the on-line shop www.citronille.fr you are deemed to have read and agreed to these conditions.

As a result, you acknowledge that you are fully aware that your handwritten signature is not required for you to be bound by these conditions, in so far as you wish to place an on-line order for products for sale in the on-line shop.

You may save these conditions electronically or print them, on the understanding that you alone are responsible these actions.

Citronille draws your attention to the fact that the patterns are sold to you for private use only. Any wider usage of the patterns, their reproduction, duplication, adaptation and/or exploitation, by whatever means and in whatever form, is strictly prohibited without our prior consent.

We retain all author’s rights and intellectual property rights upon the texts, illustrations and images reproduced on the www.citronille.com site. According to the laws on intellectual property, only the private usage of the above is permitted. Any violations will be prosecuted for counterfeit.

Prior to placing an order, you affirm that the acquisition of these goods is without direct relationship to your professional activities, and that their acquisition is limited to a strictly private usage on your part.

Thus as a consumer your rights are restricted and you will be considered to have breached these rights if you use the goods or services you buy from the on-line shop within the context of your professional activities.

These conditions are written in the English language. You acknowledge that you have full legal capabilities to honour these conditions.

These terms and conidtions define the entirety of the obligations of the two parties. On this understanding, you acknowledge that you agree without reservations to the entirety of these conditions. We will adhere to no general or specific condition submitted by you among the documents you send or deliver to us, if such a document is incompatible with these conditions.

The www.citronille.fr shop would like to draw your attention to the following information:

Orders

All prices are quoted in euros and are valid from the date your order is accepted by us and paid for in full by you. They are not inclusive of delivery costs, which are billed in addition and quoted to you prior to confirming your order.

All prices are exclusive of the VAT.
The offers of goods for sale in the on-line shop www.citronille.fr are only valid within the limits of the availability of stock.

Citronille offers goods for sale from its on-line shop with the characteristics required for adherence to article L 111-1 of the French Consumer Code, which states that a potential customer must be informed of the essential characteristics of the goods he wishes to buy before placing his final order.

The documents, texts and photos published on the site are not contractually binding in the case of errors and omissions. Citronille cannot be held responsible for errors appearing on the site.

Availability of Goods

Your order will be dispatched at the latest 3 days from the day after it is placed. If the goods you order are unavailable, typically because of supplier failure, we will let you know of this as soon as possible and give you the option to cancel your order. You will then be given the choice of either receiving a full refund within a 30 day period of your original payment, or of exchanging your goods.
Methods of payment

You can make payment of the full balance via the secure PAYPAL website. You affirm that you have all the necessary authorizations to use your chosen method of payment at the time your order is confirmed. Your order will only be processed once the total balance for the goods ordered and their delivery costs have been paid for in full.

Delivery

Your goods will be dispatched to the address you give us at the time of placing your order. You are required to check the condition of the packaging of your order upon delivery and to inform both the carrier and Citronille of any damage to it within 48 hours. Deliveries are made by La Poste (the French postal service) and orders of more than three patterns are sent recorded and signed for delivery (colissimo suivi avec signature).

Delivery Delays/Parcel Loss

La Poste provides a reliable service. However, as with any dispatch, deliveries are sometimes delayed, or parcels lost. If a delivery is delayed in relation to its date of dispatch, please let us know by telephone or email. We will contact La Poste to set up an inquiry. A postal inquiry can take up to 21 days from the date it is launched. If the parcel is found during this period, it will be redirected to your home immediately. However, if the parcel is not found by the end of the 21 day inquiry, the postal service considers it lost. Only then will we send you a replacement for your order, at our expense. If the goods ordered are no longer available at that time, we will refund you the full price paid for the lost goods. We decline all further responsibility for delays in delivery, including cases of parcel loss or strikes. The exchange or refund of the purchase price will only take place after the conclusion of the postal inquiry.

Any complaints not made within the rules and time limits specified above will be dismissed and will free Citronille of any further obligations towards the customer.

Upon receiving a complaint, we will examine your case and let you know how your goods can be exchanged. In the case of delivery error or exchange, any goods to be exchanged or refunded must be returned by recorded and signed for delivery, in their original packaging and in a perfect condition for resale, to the following address :

We will only accept returns for which we receive advance notification. If the return is the result of our error, we will pay for return postage costs, unless the goods returned to us do not correspond to the original claim made by the customer in his return request.

Guarantee of Goods

The goods sold are guaranteed against all faults and latent defects. Our transport guarantee is only valid on the condition you send us your complaint in writing within 48 hours of delivery. Our seller’s guarantee is limited to the replacement or refund of the value of the goods acknowledged as defective by us, after taking into account the use to which they have been put and at our discretion. We only undertake to replace defective goods that we ourselves have supplied. We decline all responsibility in the case of misuse of the goods supplied. To the extent permitted by the laws in force, our responsibilities are strictly limited to the obligations specified in the present conditions.

Right to Return Goods

You have a right to return goods that you do not wish to keep, at your own expense, within a period of 7 clear days of delivery. If this period ends on a Saturday, Sunday or public holiday, it is extended to the next working day. You must inform us in advance of any return by logging on to the ‘Contact’ page of the Citronille website. The article must be returned by recorded and signed for delivery to :

We will only take back goods that are returned complete, in their original packaging and in a perfect condition for resale. No goods that have been damaged or whose original packaging has deteriorated will be refunded or exchanged. This right of return involves no financial penalty other than postage costs. If you wish to exercise your right to return goods, you have the option of either requesting a refund of the money paid by you, or an exchange of goods. In the case of an exchange, you will pay for the postage of the new parcel. In the case of definitive return, we will make every reasonable effort to refund you within 30 days. If you made your original payment by credit card, you will be refunded by having your bank account recredited by secure transaction.

Force majeure

Neither party will be deemed liable for failing to carry out its contractual duties, if these are delayed, hindered or prevented by casus fortuitus or force majeure. Casus fortuitus and force majeure are considered to be any unavoidable, unforeseeable, and inescapable event or circumstance beyond the control of the parties and independent of their wishes, and which they are unable to prevent despite all reasonable efforts. The party affected by such circumstances will notify the other within ten working days of the date it learned of them.

The two parties will then convene within a month, unless force majeure makes this impossible, to examine the impact of the circumstances and agree under which conditions the contract can be carried out. In a case of force majeure lasting longer than three months, the present conditions may be cancelled by the injured party. The following are expressly considered force majeure or casus fortuitus, in addition to those habitually deemed as such by the precedence of the French courts: the freezing of means of transport and supplies, earthquakes, fires, hurricanes, floods, lightening, the breakdown of telecommunication networks or difficulties with telecommunication networks beyond the customer’s control.

Applicable law

These conditions are governed by, and are to be interpreted in the light of the principles and practices of the law of France. In the case of a grievance or complaint, you must first try to obtain an amicable solution. If this fails you may address your complaint to Paris’ Tribunal de Commerce

Responsibility

For all stages, from access to the on-line shop, through the order process, delivery and follow-up procedures, Citronille only acknowledges an obligation of best effort (obligation de moyen). We cannot be held responsible for any of the potential drawbacks and injuries inherent in the use of the internet, including service breakdown, external interference or computer viruses, or any other occurrence that legal precedence deems force majeure.

Information Technology and Liberties

The data we request from you is essential for processing your order and may be communicated to our trading partners within this context. According to the French Law of 6 January 1978 on Information Technology and Liberties, you have the right to oppose such communication, or to exercise your right to access, rectify, modify or remove personal information contained within our databases.
